As the legislature adjourns in New Mexico House Bill 336 is now waiting for the Governor’s signature to go into effect.
House Bill 336 ensures that individuals who are prohibiting from possessing firearms will be submitted to and added to the NICS background check database. This includes people convicted of felonies and those adjudicated mentally insane in New Mexico. Previously there was no guarantee that these people were being submitted to the national database.
This is why shooters like the Charleston shooter are able to pass background checks despite not qualifying under federal law to own or purchase guns. This new law is similar to laws passed in 38 states and will tighten or make more effective the NICS background check system.
